Terms of Use & Acceptable Use Policy

Effective 27 September 2026 · Last updated 27 September 2026
Applies to the CaptionYourPhoto apps for Android and iOS, published by Sandbyte Technologies.

The short version

  • Caption your photos, have fun, put them on a mug. That's what this is for.
  • Use photos you are entitled to use, and be careful with pictures of other people.
  • No nudity or sexual content, no graphic violence, no hate or harassment, nothing illegal.
  • A shared link is public to anyone who has it. You decide who gets it.
  • Anyone holding a link can delete that image instantly, and so can we.

1. These terms, and agreeing to them

These terms are an agreement between you and Sandbyte Technologies (www.sand-byte.com), the publisher of the CaptionYourPhoto apps. You accept them by using the app. If you do not accept them, please do not use it.

The Privacy Policy forms part of these terms and explains what happens to your information. Buying a mug happens on our shop, which has its own terms covering the sale itself.

You must be old enough to agree to these terms where you live, and at least 13 in any case.

2. Your images stay yours

We claim no ownership of your photos or of the captioned images you make. They are yours.

To do the things the app offers, you give us a narrow permission: when you share a mug mockup or go to the shop, you allow us to store the image you chose to share, to produce mug mockups from it, to show it to anyone who opens its link, and — if you order — to send it to the printer who makes your mug. That permission covers nothing else. We do not use your images to advertise, we do not sell them, and we do not show them to anyone who has not been given the link. It ends when the image is deleted.

3. Photos you are allowed to use

You are responsible for having the right to use every photo you bring into the app. That matters most in two places:

  • Pictures of other people. Captioning a photo of someone can change what it says about them. Think about whether they would be happy with it, particularly before you share it or print it.
  • Pictures you found online. The in-app image search makes it easy to bring in a photo that belongs to someone else. Being able to find an image is not permission to use it, and it is certainly not permission to print it on a mug and sell it.

4. Acceptable use

Use the app for making and sharing captioned images. Do not use it to do harm. In particular, do not use it to make, share, upload or order anything that:

Prohibited content

  • Sexual content or nudity. No nudity, no sexually explicit or suggestive material, and no sexual content of any kind.
  • Anything involving children sexually. Absolutely prohibited, without exception or excuse. We report child sexual abuse material to the authorities.
  • Graphic violence. No gore, mutilation, real violence or cruelty, and nothing glorifying it.
  • Hate and harassment. Nothing attacking or demeaning people for their race, ethnicity, national origin, religion, disability, age, sex, gender identity or sexual orientation; and no bullying, threatening, intimidating or targeting of anyone.
  • Illegal material, or content promoting or facilitating serious crime, terrorism, or self-harm.
  • Other people's rights. Nothing that infringes copyright, trademarks, privacy or publicity rights.
  • Deception. No impersonating anyone, no fake or doctored images presented as real in order to mislead, and no scams.
  • Private information about someone published without their agreement.
  • Malware, spam, or anything designed to damage or overload our service or anyone else's.

And please don't

  • attack, probe or attempt to break our servers, or try to reach images you were not given the link to;
  • use automated tools to bulk-upload, scrape or enumerate images;
  • resell or commercially exploit the service itself.

These rules apply to what you share, not to what you keep. Editing a photo on your own phone is between you and your phone — nothing is uploaded and we never see it. The rules above govern what you upload by sharing a mug mockup or going to the shop.

5. Sharing, and what a link means

When you share a mug mockup or go to the shop, the image is uploaded and gets a link containing a long unguessable code. Anyone with that link can open the image; nobody else can, and there is no listing, gallery or search of uploaded images anywhere on our service.

That makes you the one who decides who sees it. Treat the link as public: whoever you send it to can open it, keep it, and pass it on. Do not share anything you would mind a stranger seeing.

6. Deleting an image

Go to https://app.captionyourphoto.com/delete and paste in any link to the image — the shop link you shared, the address of the picture, or the code from the end of either. It shows you the image and asks you to confirm; confirming deletes it and its mug mockups at once, and every link to it stops working.

Anyone holding the link can do this, including someone you sent it to. We designed it that way on purpose: with no accounts we cannot tell one holder of a link from another, and someone who appears in a picture they did not want shared should be able to take it down without waiting on us. Shared images are also deleted automatically within two weeks.

7. Reporting something

If you find an image made with CaptionYourPhoto that breaks these rules, please tell us: info@captionyourphoto.com. Send the link if you have it, and a line about what is wrong with it.

We review reports and remove anything that breaks these rules. If you have the link, you can also delete the image yourself straight away using section 6 — you do not need our permission and you do not need to wait for us. Reports about child sexual abuse material are treated as urgent and referred to the authorities.

8. What we may do

We may remove any image from our servers, and stop providing the service to anyone, where we reasonably believe these terms have been broken or that harm is being done — with notice where it is practical to give it, and without where it is not. We may also cancel an order for a mug whose design breaks these rules, and refund it.

We do not review images before they are uploaded, and we are not obliged to monitor what people make. That does not make anything on this list acceptable.

9. Mugs and orders

Ordering happens on shop.captionyourphoto.com, and the sale, payment, delivery, returns and refunds are governed by the terms published there. By ordering a mug you confirm you have the right to have that design printed.

10. The app itself

The app, its name and its artwork belong to us, and these terms give you permission to use the app, not to copy, resell or reverse-engineer it. We may change, suspend or discontinue features of the app or the service — including the sharing and mockup features — at any time.

11. No warranty, and limits on liability

The app and the service are provided "as is" and "as available". We do not promise they will be uninterrupted, error-free, or that an uploaded image will remain available for any period — it is deleted within two weeks by design, and can be deleted sooner by anyone holding its link. Keep your own copy of anything you care about; the copy on your phone is yours and is not affected by any deletion on our side.

To the fullest extent the law allows, we are not liable for indirect or consequential loss, for lost profits, or for loss of data or images. Nothing in these terms limits liability that cannot lawfully be limited, including for death or personal injury caused by negligence, or for fraud. If you are a consumer, you keep all the rights your local consumer law gives you, and nothing here takes them away.

12. Changes to these terms

We may update these terms. The date at the top says when they last changed, and significant changes will be noted in the app's release notes. Continuing to use the app after a change means you accept the updated terms.

13. Governing law

These terms are governed by the laws of Ireland, and the Irish courts have jurisdiction over any dispute. If you are a consumer in another country, this does not deprive you of the protection of the mandatory consumer law of the country you live in.
